NOTICE OF CONSULTATION

ML 100190 – Gary John Bate
Cape York United #1 Claim (QUD673/2014)

On 4 September 2019, the State of Queensland issued a notification under s. 29(2)(b) of the Native Title Act 1993 (Cth) (NTA) to the Registered Native Title Claimant of the Cape York United Number 1 Native Title Claim (QUD673/2014) (CYU#1 Claim) of the proposed grant of Mining Lease (ML) 100190 to Gary John Bate. ML 100190 is subject to the right to negotiate under s. 31 of the NTA.

Cape York Land Council (CYLC) will facilitate a meeting with those people who hold or may hold Native Title rights and interests within the CYU#1 Claim subject to the proposed grant of ML 100190 to Gary John Bate.

Gary John Bate has accepted an invitation to attend this meeting.

Venue: Jackaroo Motel, 340 Byrnes Street, Mareeba QLD 4880

What is the purpose of this meeting?

The purpose of this meeting is for Gary John Bate to discuss the project and the draft terms of an ancillary agreement currently being negotiated with the Registered Native Title Claimant of the CYU#1 Claim.

CYLC’s lawyer assisting the Registered Native Title Claimant of the CYU#1 Claim will provide information and seek instructions in relation to:

  • the right to negotiate procedure under s. 31 of the NTA;
  • cultural heritage that may be affected within the ML area;
  • the draft terms of an ancillary agreement being negotiated with Gary John Bate.

Travel Attendance

CYLC will prioritise assisting elders and family representatives and will consider how limited funding can be allocated to support a broad representation of the affected Native Title Holders.
