With assistance from its legal representatives in this matter, Lama Lama Aboriginal Corporation RNTBC ICN 9758 (LLAC) will hold a consultation and consent meeting with members of the Lama Lama Native Title Claim Group about a proposed Indigenous Land Use Agreement (ILUA) between LLAC and the Lama Lama Land Trust.

ILUA Area
The ILUA Area is depicted by the blocks with diagonal lines below. It is an area within the Cape York Land Council’s Representative Aboriginal/Torres Strait Islander Body Area and covers all the land and waters within four land parcels that fall entirely within Native Title Determination QUD673/2014 Lama Lama People (QCD2022/008), described as Lot 7 on SP189946, Lot 17 on SP148785, Lot 13 on SD21 and Lot 2 on SP161903.
Who is invited to attend the meeting?
The meetings are open to all descendants by birth, or adoption in accordance with traditional law and custom, of one
or more of the following apical ancestors:
- Ayu’wa
- George Balcultha
- Frank Balser;
- Paddy Bassani;
- Billy (Kuparranyanhu) (father of Harry Coutts);
- Old Man Billy/Willy (Waarrathu/Nangayurrkumu);
- Charcoal and his sister Aangkaykuupi;

- Jerry Crowbar (aka Kingie Jerry);
- Dyatu (spouse of Kuwarwar);

ILUA Details
The Gravel Take and Timber Harvesting Indigenous Land Use Agreement will provide for:
- Native Title Holder consent to the doing of the Agreed Acts and Relevant Acts to the extent that they are
Future Acts.
“Agreed Acts” means all acts necessary to give effect to this Agreement, including:- the Lama Lama Land Trust and the Cook Shire Council entering into and complying with the Proposed Lease;
- the Lama Lama Land Trust and the Cook Shire Council entering into and complying with the Urgent Works Agreement;
- The Lama Lama Land Trust and a Harvester entering into the Previous Timber Harvesting Agreements;
- The Lama Lama Land Trust granting a Proposed Timber Harvesting Agreement to a Harvester; and
- Relevant Acts.
- “Relevant Acts” means the renewal, extension, or variation of the Proposed Lease or the Proposed Timber Harvesting Agreement by written agreement of the parties and in accordance with clause 7.
- Subject to compliance with the Agreement, if any of the Agreed Acts done prior to the Registration Date are invalid Future Acts, the parties agree to the validating of those Agreed Acts.
- If the Lama Lama Land Trust intends to renew, extend or vary the Proposed Lease or Proposed Timber Harvesting Agreement, the Lama Lama Land Trust will give notice to the RNTBC. The parties will then arrange meeting logistics to negotiate and agree any additional Compensation payable to the Native Title Holders for the Agreement Area arising from the renewal, extension or variation of the Proposed Lease or Proposed Timber Harvesting Agreement contemplated under clause 7. The parties agree that any additional Compensation negotiations will be conducted in good faith and will be consistent with and subject to reasonable market and commercial influences.
- The RNTBC and the Lama Lama Land Trust acknowledge and agree that any benefits to be provided by the Cook Shire Council or a Harvester in exercise of the Agreed Acts are (where monetary) to be paid to the Nominated Entity on behalf, and for the benefit, of the Native Title Holders for the Agreement Area, except for any administration or project management costs that are reasonably retained by or paid to the Land Trust (or its agent or service provider as nominated in either the Proposed Lease or the Proposed Timber Harvesting Agreement), which may not exceed 20% of the monetary benefits paid by the Cook Shire Council or a Harvester.
- Nomination of the Nominated Entity to receive the benefits payable under the ILUA by the Native Title Holders.
Proposed Resolutions
The following resolutions will be presented to the Native Title Holders:
RESOLUTION 1. The relevant decision-making process
1.1. An Indigenous land use agreement (ILUA) under the Native Title Act 1993 (Cth), called the Gravel Take and Timber Harvesting Indigenous Land Use Agreement, has been tabled at this meeting (the “ILUA”).
1.2. There is no process of decision-making that, under the traditional laws and customs of the Lama Lama Native Title Claim Group, must be complied with in relation to agreeing to things such as an ILUA under the Native Title Act 1993 (Cth).
1.3. Because of [1.2], this meeting agrees to and adopts the following process of decision-making:
A resolution will be considered to have been passed by this meeting when a majority of those persons present who meet the following conditions agree to the resolution by a show of hands:
- those voting on the resolution are 18 years of age or older; and
- those voting on the resolution are members of the Lama Lama Native Title Claim Group described in schedule 1 of the determination of native title made by the Federal Court in Ross on behalf of the Cape York United #1 Claim Group v State of Queensland (No 9) (Lama Lama determination) [2022] FCA 773 (the “Lama Lama Native Title Holders”) who hold native title in the ILUA area, being descendants (by birth or adoption) of the apical ancestors named in the determination.
RESOLUTION 2. Adequate notice of meeting
2.1 This meeting acknowledges that Lama Lama Native Title Holders were given adequate notice of the time, place and subject matter of this meeting by the Cape York Land Council and the Lama Lama Aboriginal Corporation RNTBC.
RESOLUTION 3. Consultation
3.1 The Lama Lama Native Title Holders are satisfied that there has been sufficient consultation about the ILUA from the consultation meetings on 15 August 2023, 12 February 2024 and today’s authorisation meeting.
RESOLUTION 4. Explanation of ILUA and opportunity for discussion
4.1 The Lama Lama Native Title Holders present at this meeting:
- were given an explanation of the effect of the ILUA by a lawyer of Cape York Land Council; and
- have had the opportunity to discuss the ILUA.
RESOLUTION 5. Authorisation of ILUA
5.1 The Lama Lama Native Title Holders, as a group, authorise the making and entry into the ILUA.
RESOLUTION 6. Execution of the ILUA by the Lama Lama Aboriginal Corporation RNTBC (ICN 9758)
6.1 The Lama Lama Native Title Holders, as a group, direct the Lama Lama Aboriginal Corporation RNTBC to execute the ILUA.
RESOLUTION 7. Minor amendments
7.1 Despite any other Resolution above, the Lama Lama Native Title Holders authorise Lama Lama Aboriginal Corporation RNTBC to make or agree to any amendments to the ILUA which are:
- recommended by the Principal Lawyer of the Cape York Land Council PBC Unit; and
- either:
- reasonably necessary to secure the registration of the ILUA with the National Native Title Tribunal; or
- of a minor or technical nature.
RESOLUTION 8. Nomination of Entity to receive payments under ILUA
8.1 The Lama Lama Native Title Holders direct the Lama Lama Aboriginal Corporation RNTBC, directly after the execution of the ILUA, to notify the Harvesters and Cook Shire Council that the TBA is to be the Nominated Entity to receive payments under the ILUA.
