Cape York United #1 Native Title Claim (QUD673/2014)
This notice is to advise that Cape York Land Council (CYLC) will facilitate a meeting with those people who hold or may hold Native Title rights and interests within the Cape York United #1 Native Title Claim (QUD673/2014) (CYU#1) area subject to the proposal by Douglas Shire Council (DSC) to undertake works to replace the Noah Creek Bridge (the Project). The Project is proposed to be undertaken in accordance with the terms of a Cultural Heritage Agreement. The area surveyed to be covered by the Cultural Heritage Agreement is shown in red on the map below. The Project falls within the CYU#1 Native Title claim and an area over which Jabalbina Yalanji Aboriginal Corporation (JYAC) is the Aboriginal Cultural Heritage Body, as defined in the Aboriginal Cultural Heritage Act 2003 (Qld). DSC, JYAC and the Applicant in the CYU#1 Native Title Claim are proposed as parties to the Cultural Heritage Agreement.
On 29 October 2024, at a meeting facilitated by JYAC and attended by Cape York Land Council (CYLC) and DSC, it wasagreed that a second consultation meeting was required to consider the proposed Cultural Heritage Agreement. This meeting is being facilitated by JYAC in accordance with the agreed outcome.
Venues will be made available in Mossman and Wujal Wujal, where CYLC staff will assist in linking the locations via teleconference.

The proposed Cultural Heritage Agreement will:
- allow for DSC to undertake:
- the destruction and removal of the existing Noah Creek Bridge;
- the construction of the replacement Noah Creek Bridge;
- the construction of associated infrastructure, such as pilings, cables, causeways, ramps, drainage, roads; and
- all activities and works necessary and incidental to the works described above; and
- provide for the management, protection and promotion of Aboriginal Cultural Heritage within the Agreement Area by JYAC as the Aboriginal Cultural Heritage Body; and
- satisfy DSC’s Cultural Heritage Duty of Care as provided for in the Aboriginal Cultural Heritage Act 2003 (Qld).
Purpose of this meeting:
The purpose of this meeting is for:
- JYAC to provide information on the history of the Project proposed by DSC;
- CYLC to provide information and seek instructions on the terms of the proposed Cultural Heritage Agreement between DSC, JYAC and the Applicant in the CYU#1 Claim;
- CYLC to, if appropriate, seek instructions in relation to the authorisation of the Cultural Heritage Agreement.

Travel Attendance
CYLC has limited funding available for travel assistance to this meeting. CYLC may be able to provide some assistance, for example fuel reimbursement. CYLC will prioritise assisting elders and family representatives and will consider how limited funding can be allocated to support a broad representation of the affected Native Title Holders.
