Cooktown
This notice is to advise that the Applicant in the Cape York United#1 Claim (CYU#1 Claim) will conduct a workshop on 29 July 2024 in Cooktown for all members of the Yiithuwarra Native Title Group in relation to Prescribed Body Corporates (PBCs). The Native Title Act 1993 (Cth) (NTA) requires a PBC to be appointed by the Federal Court to represent native title holders whenever a native title determination is made. If a native title determination is made for the Yiithuwarra Native Title Group, the Federal Court will be required to determine a PBC to represent the group. Under the NTA, it is for native title holders to nominate their PBC.
Cape York Land Council (CYLC) will facilitate the meeting. This meeting is in addition to the information meeting about a proposed native title determination for the Yiithuwarra Native Title Group that is scheduled to be held on 6 August 2024.
The PBC meeting will be held as follows:

Venue: PCYC Cooktown, 3 May Street, Cooktown
The purpose of this workshop is to provide information about PBCs before the Yiithuwarra Native Title Group are asked at the authorisation meeting on 27 August 2024 to make a decision about the PBC that they wish to nominate.
The following matters will be discussed at the workshop:
(a) What is a PBC;
(b) What are the roles and responsibilities of a PBC;
(c) The roles and responsibilities of directors of PBCs; and
(d) Options available to the Yiithuwarra Native Title Group in relation as to which corporation the group wishes to nominate to be the PBC for the proposed Yiithuwarra determination area. The options available are:
(i) A new corporation. CYLC will provide copies of a ‘best practice’ PBC rule book and explain this rule book at the meeting; or
(ii) An existing corporation, subject to that corporation agreeing to the nomination, amending its rule book to comply with relevant legislation, and amending its membership eligibility requirements to reflect the definition of the Yiithuwarra Native Title Group in the proposed determination before the determination hearing in November 2024. The Applicant in the CYU#1 Claim is not presently aware of any existing corporation that wishes to be considered to be nominated as the PBC for the Yiithuwarra Native Title Group.
CYLC has invited representatives from the following to attend and present at the workshop:
- the National Native Title Tribunal
- the Office of the Registrar of Indigenous Corporations; and
- the PBC Unit of CYLC.

CYLC has limited funding available for travel assistance to this meeting. CYLC may be able to provide some assistance, for example fuel reimbursement. CYLC will prioritise assisting elders and family representatives, and will consider how limited funding can be allocated to support a broad representation of the descendants of all apical ancestors at the meeting.
